CSQ Funding Eligibility

Ensure that you meet the eligibility requirements for both the Course and CSQ funding.

  1. Course Eligibility – as per website page for course

2, CSQ Applicant Eligibility

As proof of eligibility to access this funding, I hereby declare the following to be true and correct:

Eligible Participant Means:

(a) An Eligible Worker;  (as per definition below) and

(b) an Existing Worker, including relevant clerical, administration and professional staff; (as per definition below)

and

(c) if an Apprentice, in the 3rd or 4th year of the apprenticeship (higher level skills general contract); or

(d) an Unemployed Eligible Worker.

AND MUST BE

  1. an Australian or New Zealand Citizen; or
  2. a permanent resident of Australia: or
  3. a refugee and humanitarian visa holder

AND MUST:

  1. permanently reside in Queensland; or
  2. be permanently employed in Qld

NON Eligible Participants are: (Higher level Skills General Contract)

  1. those that do not meet the above Participant worker eligibility
  2. an Employee of any Authority (excluding employees of an Indigenous Council that is a Principal Contractor);
  3. currently enrolled and participating in a Queensland secondary school program;
  4. a contracted trainer or assessor or existing worker of an RTO;
  5. previously funded under this Program in the same Contract Term;
  6. funded by an Authority or such other source for delivery of the same Training being undertaken as part of this Program; or
  7. other individuals that do not meet Participant Eligibility as prescribed in Item 1 of Schedule 3

NON Eligible Participants are: (Higher level Skills Civil Contract)

  1. a) those that do not meet the above Participant worker eligibility
  2. b) currently enrolled and participating in a Queensland secondary school program;
  3. d) a contracted trainer or assessor or existing worker of an RTO;
  4. e) previously funded under this Program in the same Contract Term;
  5. f) funded by an Authority or such other source for delivery of the same Training being undertaken as part of this Program;

An Eligible Worker has the same meaning as the Building and Construction Industry (Portable Long Services Leave) Act 1991 (Qld) as amended from time to time.

Who is an Existing Worker Definition

An Existing Worker is a current Employee in the Building and Construction Industry who has a one month or more employment relationship with their Employer. The working relationship can be built up through full-time, part-time or casual employment or engagement as a contract worker.

An Unemployed Eligible Worker is a person who has been unemployed for a period of not greater than 6 months that would otherwise meet the requirements of an Eligible Worker.

Must provide Written Consent to enable Construction Skills Queensland to contact the Participant for the purposes of including but not limited to:

  1. a Review;
  2. conducting Destination Surveys; and/or
  3. contacting them for the purposes of advising a Participant of Construction Skills Queensland products and services, whether current or fu

You Must provide the following Documentation to prove your eligibility 

  • Proof of Identity and being an Australian or NZ citizen, a permanent resident of Australia or refugee and humanitarian visa holder

One (1) of the following:

  1. Full Birth Certificate or Birth Certificate Extract;
  2. Passport;
  3. Medicare card (green only); or
  4. Visa (as per Schedule 3 – Participant Eligibility).

(ii) Proof of permanently residing in Queensland

One (1) of the following:

  1. Queensland Driver Licence;
  2. Telephone account;
  3. Bank statement;
  4. Statement from a real estate agent; or
  5. Any other formal documentation stating the Participant’s full name and current residential address; and

(iii) Evidence to verify Participants meet the Existing and Eligible Worker criteria for employment in the Building and Construction Industry.

Evidence provided may include but is not limited to the following:

  1. the name of the Employer;
  2. job title of Employee;
  3. length of service with the Employer;
  4. details of what duties are being undertaken in the Building and Construction Industry.

and must be verified by way of either:

  1. payslip showing the above details; or
  2. a letter signed by the Participant’s employer confirming the above details; or
  3. if the Participant is self-employed, a copy of an invoice detailing work undertaken for a client; or
  4. if none of the evidence required for (iii) is readily available and includes all of the details required, a statutory declaration confirming the above details will be acceptable.

(iv) Evidence that demonstrates unemployment for a period less than 6 months.

If you work permanently in Qld but not a Qld resident than make sure you provide this information also on the employment evidence.

 Building and Construction Industry Terms

1.1   The building and construction industry is the industry of constructing, deconstructing,

reconstructing, renovating, altering, demolishing, relocating, maintaining or repairing any of the following –

  • buildings;
  • spa pools and swimming pools;
  • roads, railways, airfields or other works for the passage of anything;
  • breakwaters, docks, jetties, piers or wharves;
  • works for solid waste disposal;
  • works for subdividing or developing land;
  • works for the improvement or alteration of a harbour, river or watercourse for navigation purposes;
  • works for the storage or supply of water or for flood mitigation;
  • works for the irrigation of land;
  • works for the conveyance, treatment or disposal of sewage or of the effluent from any premises;
  • works for extracting, refining, processing or treating materials or for producing or extracting products and by-products from materials;
  • works for conveying products, by-products or materials;
  • works for the drainage of land;
  • works for the storage of liquids, other than water, or gases;
  • works for the generation, supply or transmission of electric power;
  • works for telecommunication or for the transmission of radio or television;
  • bridges, viaducts, aqueducts or tunnels;
  • chimney stacks, cooling towers, drilling rigs, gas holders or silos;
  • pipe lines;
  • navigational lights, beacons or markers;
  • pile driving works;
  • sporting or recreational facilities;
  • earthworks, other than for farming;
  • fences, other than fences on farms;
  • structures, fixtures or other works not included in paragraphs (a) to (x), but not including earthworks for farming or fences on farms.

1.2   The building and construction industry also includes land clearing and site preparation, other

than for farming.

1.3   The building and construction industry also includes the industry of, whether on or off site –

  • constructing a thing, other than ordinary stock for sale, in accordance with working drawings; or
  • deconstructing, reconstructing, renovating, altering, demolishing, relocating, maintaining or repairing a thing, other than ordinary stock for sale, constructed in accordance with working drawings.

1.4   The building and construction industry does not include the industry of performing maintenance or repairs of a minor nature to anything mentioned in subsection 2.1 or 2.3 for a person not substantially engaged in activity mentioned in subsection

 Who is an Eligible Worker Definition

As defined in the ‘Building and Construction Industry (Portable Long Service Leave) Act 1991 Page 9’

 (1)    An eligible worker is an individual who—

  • under a contract of service is engaged to perform work in the building and construction industry for the majority of the person’s ordinary hours of work; or
  • under a contract, whether or not the contract is a contract of service, or at piecework rates, is engaged to perform work in the building and construction industry, for labour only or substantially for labour only, for the majority of the person’s ordinary hours of work; or
  • under a contract, whether or not the contract is a contract of service, performs work in the building and construction industry for the majority of the person’s ordinary hours of work, unless—

(i)    the individual—

  • is paid to achieve a stated result or outcome; and
  • has to supply all, or substantially all, of the plant and equipment or tools of trade needed to perform the work; and
  • is, or would be, liable for the cost of fixing a fault with the work performed; or

(ii) a personal services business determination is in effect for the individual performing the work under the Income Tax Assessment Act 1997 (Cwlth), section 87-60.

(2)    Also, eligible worker includes—

  • an individual who is engaged to perform both work and supervision of other workers in the building and construction industry, whether or not the individual is known as a supervisor, leading hand or another title; and
  • an individual who is appointed as a safety officer by the person conducting a business to advise the person in relation to work health and safety duties under the Work Health and Safety Act 2011, in relation to building and construction work, whether or not the individual performs or usually performs building and construction work.

(3)    This section is subject to section 3B.

 

3B        When an individual is not an eligible worker

(1)    An individual is not an eligible worker if—

(a) the individual performs work in the building and construction industry—

  • in a managerial, clerical, professional or ancillary capacity; or
  • under a contract of service with a partnership if the individual is a partner and participates in the management of the partnership or shares in its profits; or

(iii) under a contract of service with a government entity or a local government; or

  • the individual is engaged under a contract of service with a non-Queensland government entity; or
  • a regulation declares the individual is not an eligible worker because the work the individual performs is subject to stated coverage under a stated industrial instrument within the meaning of the Industrial Relations Act 1999; or
  • the individual performs qualifying service within the meaning of the Coal Mining Industry (Long Service Leave) Administration Act 1992 (Cwlth), section 39A(2).

(2) Also, an individual who would otherwise be an eligible worker under section 3A(1) or (2) is not an eligible worker if the individual is engaged to perform building and construction industry work by—

  • a government entity; or
  • a local government; or
  • Mount Isa Mines Limited ACN 009 661 447; or
  • a person who is not substantially engaged in the building and construction industry.

(3)    Subsection (2)(d) does not apply if the individual is a party to a contract with a labour hire agency that arranges for the individual to perform building and construction work for someone else under an arrangement between the agency and the other person.

(4)    In this section— arrangement includes agreement, promise, scheme, transaction, understanding and undertaking, whether express or implied.

4           Meaning of substantially engaged in the building and construction industry

A person is substantially engaged in the building and construction industry if the person—

  • is ordinarily engaged in work in the building and construction industry as part of the person’s usual business activities; or
  • is ordinarily ready to perform, for reward, work in the building and construction industry.
